Frequently asked questions
Straight answers to what clients ask us first.
Can I open an LLC in Florida without living in the U.S. or having a Social Security number?
Yes. Florida does not require residency or a Social Security number to own an LLC. We register the entity, obtain the EIN and put Form 5472 on the calendar, which a single-owner LLC with a foreign owner must file every year it has a reportable transaction with its owner.
What is FIRPTA and how does it affect me when I sell?
When a foreign person sells U.S. real estate, the buyer generally must withhold 15% of the sale price and send it to the IRS. If your actual tax is lower, Form 8288-B can request a reduced withholding, and the balance is settled on your 1040-NR for that year.
Do I need an ITIN to file?
If you are not eligible for a Social Security number, yes. The ITIN is requested with Form W-7, normally attached to your first return. It is for tax purposes only and does not change your immigration status or allow you to work.
Can everything be done without travelling to Miami?
Yes. Meetings are by phone or video, documents are shared securely and filings are electronic where the IRS allows it. The only step that may need originals is the ITIN application, and we explain the options before you send anything.
